This Privacy Policy applies to our BEERWULF website for consumers in France, available at https://www.beerwulf.com (the “Website”), where we, Beerwulf B.V. (Westeinde 16, 1017 ZP Amsterdam, the Netherlands) (“Beerwulf”), collect certain Personal Data. Beerwulf is part of the HEINEKEN Group.
Please read this Privacy Policy carefully, as it contains important information to help you understand our practices regarding the Personal Data you provide to us or that we otherwise collect in connection with operating the Website (“Personal Data”). Beerwulf B.V. (“we” or “us”) is the controller of the Personal Data collected and processed.
We respect your privacy and are committed to keeping your Personal Data secure and processing it in accordance with our legal responsibilities under applicable data protection laws.
What Personal Data we collect and how we use your Personal Data
You can use most of our Website without having to provide us with Personal Data. For certain services and purposes of the Website, you must provide us with Personal Data, for example so that we can process your orders or send you newsletters or other information.
When you visit our Website, we collect data in addition to the data you are required to provide. Some information requested on the Website is mandatory. If you do not provide the requested information, we will not be able to provide you with the service or product.
We set out below the Personal Data we collect, the purposes for which we use it and the general retention period for such data.
1) Processing your order
To process your payment and provide you with the requested product or service, we need your name, email address, telephone number, postal address or the address of the recipient of our services, date of birth, and payment information.
We will also use this for our sales administration.
This Personal Data is used to perform our agreement with you or to comply with legal obligations, such as tax and accounting rules. We will retain our online sales records for 7 years, or longer if required for tax or company accounting purposes.
Registration and creating an account on our Website
Before making a purchase, you can create an account and provide us with a login ID and password, which we need to manage your account, as well as an email address, first name/surname, telephone number, billing address and date of birth, which we will use to process your order or contact you in case of irregularities relating to your order.
You can manage your account information yourself and view, for example, previous purchases you have made. We will retain your account information for as long as you actively use your account. After 1 year of inactivity, we will delete your account. You can also request deletion of your account via the Contact Us section.
You may also choose to purchase our products as a “guest”. In that case, we will record your order in our back end and create a unique customer ID containing your contact details. If you then make another purchase, we will be able to associate that order with the same contact details. This allows us to avoid duplicate data and ensure proper processing of your purchase order. You can also request deletion of this data via the Contact Us section.
2) Customer services
If you have any questions, you can contact us via the Website or by phone. We may also contact you in the event of product recalls or to send you other service messages.
For these purposes, we will process your email address, name and/or telephone number. We record your requests and questions, our responses, and any actions taken to process your request.
We will record calls when you contact us by phone. You are free to state at the beginning of the call that you do not wish the call to be recorded.
BEERWULF will retain all information for 1 year after your question, complaint or request has been resolved.
3) Sending commercial messages
We use several methods to send you commercial messages. You can subscribe to receive commercial messages, such as newsletters, and in that case we will use the contact details you provided, such as your email address, social media account or telephone number, to send you our commercial messages.
In addition, when you purchase a product from us, you are also automatically added to our customer database. You will therefore receive commercial messages about similar products or services, unless you object to this processing of Personal Data at the time of your purchase.
If you no longer wish to receive commercial messages from us, you can unsubscribe at any time using the unsubscribe function in each email message or by contacting us.
Where required by law, we request your consent before sending you commercial messages. In the case of an existing business relationship, we use your Personal Data because it is in our legitimate interest to send information about our products to existing customers.
We will delete your contact details once you have opted out of receiving commercial messages, unless they are also used and retained for other purposes listed in this Privacy Policy.
4) Marketing
We may combine information about your purchases, online searches and social media activity, such as Twitter, LinkedIn, Facebook and Instagram, including clicks and views, your settings on our Website, items in your shopping basket, customer service requests and contact history.
This information allows us to use different channels for relationship management and marketing our products and services to you through commercial messages, emails, social media, apps or online advertising. This may include personalising Website, email, app and social media content and offers so that they are tailored to your preferences.

Personal Data will generally be deleted or anonymised 2 years after your last order on our Website, unless we are legally required to retain the Personal Data or it is retained for another purpose.

We use this information to perform and manage our contractual relationship with you once you have participated in the prize draw, competition or other promotion.
9) Facilitating Trusted Shops services
Beerwulf holds the “Trusted Shops” certificate and has integrated the Trusted Shop Trustbadge into its Website. This is a Trusted Shops visual graphic displayed on the homepage of our Website.
When you click on the Trustbadge, a cookie is installed and the following data is shared with Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne, Germany: server log file with your IP address, date and time of clicking on the Trustbadge on our Website.
This data will be deleted by Trusted Shops after 7 days. Beerwulf will not have access to this data.
In addition, we use Trusted Shops to send you an email asking you to review and rate your order. These emails are only sent to people who have chosen to receive updates from Beerwulf.
The following data is shared with Trusted Shops and will be used only for this purpose: email address, name and product URL, product image, product name, product SKU, GTIN and MPN, manufacturer.
Your review and rating, which may include your name, may be used by Beerwulf for promotional purposes.
Finally, at checkout, you may choose to use the “Trusted Shops” buyer protection service. Your purchase date, purchase number, customer ID, amount, currency, delivery date, payment method and email address will then be shared with Trusted Shops for this purpose. How we share your Personal Data
As part of an international company, we share information acquired through cookies with HEINEKEN Group subsidiaries and affiliates for aggregated analysis and operational purposes, retargeting, creating consumer audiences or lookalike audiences where permitted by local law, and enriching existing customer profiles.
We only share this cookie data where legally permitted. This means we will request prior consent where this must be the legal basis. If the law allows us to rely on our legitimate interest, we will do so. This is the case when we create aggregated marketing insights or segments.
We need to share Personal Data with third parties so that they can help us provide services and products to you and operate our Website. These third parties are:

In addition, we may use, disclose or transfer your information to a HEINEKEN Group company in the event of a reorganisation, merger, sale, joint venture, assignment, transfer or other disposal of all or part of our business, assets or shares, including in connection with bankruptcy or similar proceedings.
Independent debt collection agencies, lawyers or other agents for the purpose of collecting sums due or payable on your account.
If HEINEKEN sells to a third party all or part of the assets or shares of a HEINEKEN Group company to which Personal Data has been transferred, your Personal Data may be provided to that third party.
Internal and external advertising companies.
Media agencies for marketing and research purposes.
Social media providers, such as Twitter, LinkedIn, Facebook and Instagram.
These third parties may be located in the Netherlands, the United Kingdom, France, Germany, Belgium or other countries in the European Economic Area, or elsewhere in the world.
Where we transfer Personal Data outside the EEA, we ensure an adequate level of protection for the transferred Data. We require service providers to use appropriate measures to preserve the confidentiality and security of Personal Data.
We may also need to provide Personal Data to law enforcement bodies in order to comply with any legal obligation or court order.

You have the right to receive the Personal Data you provided to us in a structured, commonly used and machine-readable format and, in certain circumstances, we will transmit your Data to another controller at your request where technically possible.
Your right to object
You also have the right, in certain circumstances, to ask us to stop processing your Personal Data, but where we have compelling legitimate grounds, we will continue to process your Personal Data.
However, you have the right to object to our use of your Personal Data for direct marketing purposes, including profiling, and in that case we will comply with your request.
Where you have given consent to our use of your Personal Data, you have the right to withdraw your consent without affecting the lawfulness of our use of that Data before your withdrawal.
